Privacy is our priority. We understand you may be sharing sensitive information and we take that responsibility seriously. Your data is stored securely encrypted on our servers, and we operate with strict policies protecting your data privacy.

If you have opted into sharing your conversation transcripts, no voice data is stored. Conversation text is scrubbed for all personal information and then used exclusively to make MentalHusk smarter. Your mental health journey helps MentalHusk understand and improve for other people who go through similar challenges to you.

Because we're in the early stages, these terms might change slightly over time. You can always find the most recent copy of these terms on this page. And while the details might change, our commitment to your privacy never will.

1. Information We Collect

We may collect both Personal Information (i.e., information that identifies you or other individuals) and Non-Personal Information (i.e., information that does not identify you or any other individual, directly or indirectly).

We may collect the following types of Personal Information:

  • Account Information: We may collect full names and email addresses when you establish an account on our Platform or when you provide it to us in connection with sending us an inquiry or other communication.
  • Contact Information: We may collect email addresses, postal addresses and phone numbers when you establish an account or provide such information to us in connection with inquiries.
  • Online Identifiers: We may collect your Internet Protocol (IP) addresses automatically as you use the Platform.
  • Conversation Data: In order to provide services on our Platform, we collect information included within a conversation in which you engage using our online tools or services. You have the choice to make Conversation Data available to our team to make MentalHusk better.
  • Platform Usage Data: We may collect data regarding the ways in which you use the Platform, such as web pages visited, time spent on web pages, hyperlinks clicked, number of Platform sessions, and start and end times.
  • Geolocation Data: We may collect geolocation data which generally identifies the area of the device used to access the Platform.
  • Device Type: We may collect information about the type of device that is used to access the Platform.

2. How We Use and Disclose Information

We may use and disclose Personal Information as described below:

  • We may use your names and contact information to operate and provide our Platform, including to provide specific Platform services, enable you to establish and maintain accounts, and communicate with you.
  • We may disclose your names and contact information to our service providers and affiliates that assist us in supporting our business functions.
  • We may use online identifiers to remember your preferences on the Platform and to operate and provide the Platform.
  • We may use Conversation and Platform Data to improve the Platform (e.g., for model training) and for research purposes to understand and improve the service.
  • We may use any Personal Information as needed to comply with applicable law, regulation, legal process, subpoena or governmental request.
  • We may use Platform usage data, geolocation data and device type data to identify, address and resolve technical issues and facilitate Platform operation.
  • We may use such data to remember user preferences and customize the Platform.
  • We may use such data for analytics purposes to analyze trends and improve the Platform.

3. Legal Basis for Processing

We must have a legal basis to process your Personal Information. In most cases the legal basis will be one of the following:

  • Contractual Obligations: To fulfill our contractual obligations to you, for example, to provide you with the Platform in accordance with our Terms of Service.
  • Legitimate Interests: To pursue our legitimate interests, for example, to improve our Platform.
  • Legal Compliance: To comply with our legal obligations, for example, to cooperate with regulators and law enforcement bodies.
  • Consent: With your consent. If consent is the legal basis, you can withdraw your consent at any time by contacting us.

4. Data Security

We implement information security measures designed to maintain the security and integrity of the Personal Information that we collect and maintain. Examples of security measures that we use include:

  • Use of multi-factor authentication by our employees
  • Password protection and management
  • Role-based access control for authorized personnel

Your Conversation Data is stored securely with full encryption on our servers. Our encryption protocols ensure that team members across engineering, product, and customer service cannot access your conversation data under any normal operational circumstances.

To help protect your privacy, we remove information directly identifying you and assign a unique code which is associated with your information. We securely maintain the key which links the codes to identifiable users and allow only authorized personnel to access it.

5. Links to Third-Party Sites

Our Platform may include links to third-party websites. We do not endorse or recommend such third-party websites and are not responsible for the privacy practices of the operators of those websites. We encourage you to read the privacy policies which may apply to your use of third-party websites.

6. Children Under 13

Our Platform is not intended for use by children under the age of 13 and we do not knowingly collect Personal Information from children under the age of 13. If you become aware that we have collected Personal Information from a child under age 13, please contact us at help.mentalhusk@gmail.com so that we may seek to delete such Personal Information.

7. Direct Marketing

Depending on the choices you have made, you may receive direct marketing communications from us. We may use your name and contact information to send such communications to you. Direct marketing communications may include updates about our products and services and other promotional material.

When we send direct marketing communications to you via email, we will include an unsubscribe link in the email which allows you to opt out of receiving further direct marketing emails from us.

You may also choose to receive direct marketing communications through push notifications within our application. You may, at any time, discontinue these notifications by changing the application settings to disable such notifications.

8. Our Service Providers

We work with third-party service providers and disclose Personal Information to those providers so that they may assist us with certain activities. We carefully evaluate the information privacy and security practices of those providers prior to engaging them and select only those providers that we reasonably determine are able to adequately protect Personal Information.

9. International Data Transfers

In connection with providing our Platform, we may transfer information (Personal Information) internationally from the country in which you access the Platform to other countries around the globe, as permitted by applicable laws. We may transfer such information to a country that does not have the same privacy or data protection laws as the country in which such information was collected. Accordingly, such information may be subject to different legal protections depending on the laws and regulations of the country to which the information is transferred.

10. Tracking Tools

We use certain tools and programs to track Platform usage in accordance with applicable laws. We use Tracking Tools to understand how you use our Platform, including how often you use the Platform and how you interact with certain components of our Platform.

The information we obtain from the use of Tracking Tools enables us to improve the Platform and make it more user-friendly and convenient.

You may disable Tracking Tools by modifying your browser settings, but if you do so, some features on our Platform may not function as intended.

11. Retention of Personal Information

We may retain Personal Information until the purposes of using and disclosing such information described in this Privacy Policy have been fulfilled, in each case as permitted under applicable laws and regulations. For example, we retain your Conversation Data as long as you remain an active user. However, you may, at any time, request that we delete your Personal Information as specified in the section below titled "Your Choices Regarding Personal Information".

12. Your Choices Regarding Personal Information

Subject to data protection laws, you may have certain rights with respect to your Personal Information, including:

  • The right to request a copy of the Personal Information which we hold about you
  • The right to request that we correct any Personal Information if it is found to be inaccurate or out of date
  • The right to request your Personal Information is erased where it is no longer necessary to retain such data
  • The right to withdraw your consent to the processing at any time, where consent was the lawful basis for processing your Personal Information
  • The right to request that we provide you with your Personal Information and, where possible, to transmit that data directly to another data controller (known as the right to data portability)
  • The right to request a restriction is placed on further processing where there is a dispute in relation to the accuracy or processing of your Personal Information
  • The right to object to our processing of Personal Information, where applicable

With regard to Conversation Data that we maintain about you, you also have the option of requesting deletion of this data by clicking the "delete my data" button within the user interface on our Platform and then confirming this selection.

If you maintain an account with us and you would like us to delete your name and contact information, you must (a) delete your account; and (b) send an email to us at help.mentalhusk@gmail.com requesting deletion of your name and contact information. We will respond to your request as required by any applicable laws or regulations. In some instances, to protect your Personal Information we may need to confirm your identity before actioning your request.

13. Privacy Policy Changes

We may change this Privacy Policy from time to time. We will post any updated version of this Privacy Policy on our Platform. Please check the Platform frequently to ensure you have reviewed the most recent version of the Privacy Policy.
